GPSR: the EU rules that changed in December 2024

The enforcement most sellers meet is not an inspector. It is a marketplace asking for something and giving you a week.

    A responsible economic operator established in the European Union is required for products placed on the EU market — a manufacturer or importer in the Union, an authorised representative, or in some arrangements a fulfilment service provider. That party can be contacted about the product and is expected to hold or be able to obtain the documentation.

    It is not satisfied by a freight forwarder, by a customs broker, or by a consumer who unknowingly becomes the importer by buying from abroad. For a seller shipping cross-border direct to EU consumers, this is a structural decision rather than a form, and it has to be made before production because the details go on the product or packaging.

    And it is a printing lead time. The operator's name and address have to appear where a consumer can find them, so a decision taken late is a decision taken after the artwork is at the printer.

    Whoever plays the role has real exposure, which is why authorised-representative services exist as a commercial product and why their contracts matter. Read what they will and will not do, particularly around holding documentation and handling a safety incident.

  2. What has to be on the product and in the file

    Identification and traceability. The product should carry a type, batch or serial identification, and the name and contact address of the manufacturer and of the responsible operator, on the product where possible and otherwise on the packaging or in an accompanying document.

    Safety information and instructions in the right language. Warnings and instructions have to reach the consumer in a language they understand in the market concerned, which is a translation and printing task with its own lead time.

    Documentation showing the product was assessed. An internal analysis of the risks the product presents, the evidence relied on, and the technical documentation that supports the conclusion.     A process for when something goes wrong. Where a product presents a risk, there are duties to inform authorities and consumers and to take corrective action, and the regulation is specific that consumers are entitled to a remedy. That means a recall is an operational capability — a way to reach buyers, a decision on the remedy, a record — not a press release.

    And distance selling has its own expectations about what the offer itself shows the consumer before purchase, which means listing content is in scope as well as the product.

  3. Why marketplaces are where this actually bites

    Platforms carry obligations of their own, and the cheapest way for them to discharge those obligations is to require the information from sellers before a listing is published. That turns a regulation with a slow enforcement machinery into a commercial gate with a fast one.

    So the practical test of readiness is not whether you could survive an inspection. It is whether you can answer a marketplace within a few days with: the responsible operator's details, the product identification, the safety documentation for the exact model, and the language versions of the instructions. If any of those lives only in a supplier's inbox, you cannot.

    Listings are removed rather than investigated. A removal is not a finding of unsafety; it is a failure to produce paperwork, and it costs the same revenue either way.

    And a general-purpose supplier declaration is the document most likely to fail. Check that whatever you hold names your model, your responsible operator, and the version of the product you actually sell — the same identity checks that apply to any test report.

    The cheapest preparation is a one-page register per product: who the responsible operator is, what the product identification is, which documents exist for which model, in which languages the instructions exist, and where all of it is stored. That converts a week of scrambling into an attachment.

  4. What it means for a China sourcing project

    Decide the responsible operator before you place the order, because the marking depends on it and the marking is printed.

    Ask the factory for documentation naming your model and your version — test reports, the technical file elements you cannot produce yourself, and the safety-relevant component list. Then apply the identity checks: model, applicant, date, standard edition, configuration.

    Write the instructions and warnings as a deliverable with the languages named, and treat translation as part of the production schedule rather than as an afterthought handled by whoever is free.

    Add the change-notification clause. A component substitution that alters a safety-relevant characteristic makes your risk analysis untrue, and the analysis is the document you will be asked for.

    And note the interaction with the brand decision. Selling a factory's product under its own brand as an importer is a different set of obligations from putting your own name on it — the regulation states that placing a product on the market under your own name or trademark makes you the manufacturer for its purposes. That is a commercial choice with a compliance price attached, and it should be made deliberately.

When did GPSR start applying?

Regulation (EU) 2023/988 applies from 13 December 2024. It changes what a seller of consumer goods must have in place — a responsible operator in the Union, traceability information on the product, documentation showing the product was assessed as safe, and a process for corrective action — rather than changing what the product itself must do.

Selling a factory's own-brand product as an importer is a different position with a different set of duties.
